Delhi HC Rejects RCB's Interim Relief Plea Over Uber Ad

The high court said the ad did not include anything insulting, critical, or false that could harm the RCB team or its brand.

On Monday, the Delhi High Court rejected a complaint by the IPL team Royal Challengers Bengaluru against a YouTube ad by Uber Moto featuring Sunrisers Hyderabad's Travis Head, saying there was no clear evidence of disrespect or trademark misuse.

The high court said the ad did not include anything insulting, critical, or false that could harm the RCB team or its brand.

Justice Saurabh Banerjee rejected Royal Challengers Bengaluru's request, saying there's no need for court action.

"All throughout the impugned advertisement, there is no (in)direct imputation/ insinuation/ comparison/ exaggeration/ sensationalism/ distortion of matters of fact of any kind by any of the defendants against the RCB trademark/ RCB cricket team," the court said.

Royal Challengers Sports Pvt Ltd filed a case against Uber India, claiming that Uber Moto's YouTube ad “Baddies in Bengaluru ft. Travis Head” harms its trademark.

While hearing RCB’s request for temporary relief, the court said the ad doesn’t appear false or misleading at this point and isn’t likely to cause serious harm to RCB if no ban is imposed.

RCB's lawyer argued that the ad shows cricketer Travis Head running toward the Bengaluru stadium, spray-painting “Royally Challenged Bengaluru” over a sign that originally read “Bengaluru vs Hyderabad,” which mocks the RCB name.

The lawyer also said Uber Moto, as a sponsor of the Sunrisers Hyderabad team, used a twisted version of RCB’s trademark for commercial promotion, which is not allowed by law.
